Do I need to go to court to get divorced?

A divorce is a legal dissolution of your marriage.  You must apply to the Family Court for a divorce to be granted. 

A divorce is not the same as a relationship property settlement.  While your application for divorce must be filed in the Court, you may negotiate a resolution of property matters and formalise this in a contracting out agreement, signed by the parties and their lawyers.
